1. About SarchBazar

SarchBazar is a digital marketplace and social commerce platform designed to support customers, vendors, businesses, sellers, founders and local-to-global commerce opportunities.

SarchBazar may provide, enable or facilitate:

• Online marketplace and product discovery
• Vendor-first marketplace services
• Digital shop and digital mall services
• Seller and vendor onboarding
• Product listing and catalogue management
• City-level and state-level marketplace models
• Social commerce tools
• Partner category integration
• Business profile pages
• Order management
• Payment, billing and refund support
• Vendor dashboard and analytics
• Promotional and advertising tools
• Founder First / self-entrepreneurship services
• Business enablement and marketplace growth services
• Customer support and grievance redressal

2. Acceptance of Terms

By using SarchBazar, you confirm that:

• You have read and understood these Terms.
• You agree to comply with these Terms and all applicable policies.
• You will use SarchBazar only for lawful purposes.
• You will provide true, accurate and complete information.
• You will comply with applicable laws, rules, regulations and third-party rights.

These Terms should be read together with our Privacy Policy, Cookie Policy, Refund Policy, Logistics Policy, Return Policy, Cancellation Policy, Disclaimers and any service-specific or vendor-specific terms shown at the time of transaction.

3. Eligibility

You may use SarchBazar only if you are legally capable of entering into a binding agreement.

If you are using SarchBazar on behalf of a company, vendor, seller, shop, partnership, proprietorship, LLP, trust or other entity, you represent that you have the authority to bind that entity to these Terms.

Users below the age permitted under applicable law may use SarchBazar only with the consent and supervision of a parent or legal guardian.

4. User Accounts

Some SarchBazar features may require account registration. You agree to:

• Provide accurate and updated information.
• Maintain confidentiality of your login credentials.
• Accept responsibility for all activity under your account.
• Notify us immediately of unauthorized account access.
• Not create fake, duplicate, misleading or fraudulent accounts.
• Not impersonate any person, customer, vendor, seller, company or authority.
• Not misuse accounts for spam, fake orders, fake reviews, fraud or manipulation.

SarchBazar may suspend, restrict or terminate accounts that violate these Terms, applicable laws or platform policies.

5. Customer Responsibilities

Customers using SarchBazar agree to:

• Provide accurate delivery, billing and contact information.
• Review product details before placing an order.
• Make payment lawfully through approved payment methods.
• Accept delivery at the provided address.
• Raise complaints, refund or return requests within applicable timelines.
• Not place fake, fraudulent, abusive or repeated non-serious orders.
• Not misuse coupons, offers, platform credits, refunds or COD options.
• Not harass vendors, delivery partners, support teams or other users.
• Not post fake reviews or misleading feedback.
• Comply with all applicable laws while using the platform.

6. Vendor, Seller and Business User Responsibilities

Vendors, sellers and business users using SarchBazar agree to:

• Provide true business, identity and contact details.
• Maintain accurate product listings, prices, stock and descriptions.
• Sell only lawful, genuine and permitted products or services.
• Not list counterfeit, stolen, unsafe, illegal or prohibited goods.
• Maintain proper packaging and dispatch standards.
• Honour confirmed orders unless cancellation is justified.
• Provide invoices, warranty details and required product information where applicable.
• Comply with tax, GST, invoicing, consumer, packaging, labelling and product safety laws.
• Handle customer data only for lawful order fulfilment and support purposes.
• Not misuse buyer data for spam, resale, unauthorized marketing or harassment.
• Not manipulate ratings, reviews, orders, traffic, discounts or marketplace rankings.
• Cooperate with SarchBazar in refunds, returns, replacements, disputes and complaints.

Vendors may be held responsible for losses, penalties, refunds, customer claims or legal consequences arising from defective products, misleading listings, fake products, poor packaging, delayed dispatch, wrong products, expired products, non-compliance or fraud.

7. Marketplace Role of SarchBazar

SarchBazar may operate as a marketplace platform that enables customers and vendors to discover, list, buy, sell, promote, fulfil or manage products and services.

Unless expressly stated otherwise, SarchBazar may act as a facilitator and may not be the manufacturer, owner, seller or direct supplier of products listed by independent vendors.

The actual sale, product quality, warranty, delivery obligations and after-sales responsibilities may remain with the respective vendor, seller, manufacturer, brand or service provider, subject to applicable law and marketplace policies.

8. Product Listings

Vendors are responsible for the accuracy and legality of product listings.

SarchBazar may remove, edit, restrict, reject or delist any product listing that violates law, platform policy, customer safety, intellectual property rights or marketplace standards.

9. Pricing, Offers and Discounts

Product prices, offers, discounts, coupons and promotional schemes may be set by vendors, SarchBazar or authorized partners depending on the service model. Users understand that:

• Prices may change without prior notice.
• Offers may be limited by time, category, location, stock or user eligibility.
• Errors in pricing may lead to order cancellation or correction.
• Discounts cannot be claimed after offer expiry.
• SarchBazar may cancel orders placed due to technical error, pricing error or misuse of offers.
• Taxes, shipping charges, platform fees, COD charges or other charges may apply.

10. Orders and Acceptance

Placing an order on SarchBazar does not automatically guarantee acceptance. An order may be confirmed only after payment confirmation, vendor acceptance, stock availability, serviceability check, fraud and risk verification, and system confirmation.

SarchBazar or the vendor may cancel an order due to stock unavailability, pricing error, payment issue, delivery unserviceability, suspicious activity, product restriction, vendor non-acceptance or other valid reasons.

11. Payments and Billing

SarchBazar may support prepaid payments, cash on delivery, wallet, UPI, cards, net banking, payment gateways, bank transfers or other payment modes where available.

SarchBazar is not responsible for delays or failures caused by banks, payment gateways, UPI networks or third-party payment systems.

12. Shipping, Delivery and Logistics

Shipping, delivery, pickup and logistics are governed by the SarchBazar Logistics Policy and product-specific delivery terms.

Delivery timelines are estimates and may vary due to location, vendor processing, courier availability, product type, weather, public holidays, technical issues, force majeure or other external factors.

13. Returns, Refunds, Cancellations and Replacements

Returns, refunds, cancellations and replacements are governed by applicable product category rules, vendor policies and SarchBazar's Refund Policy, Return Policy, Cancellation Policy and Logistics Policy.

14. Reviews, Ratings and Feedback

Customers may submit reviews, ratings, comments or feedback about products, vendors or services. Users agree that reviews must be honest, relevant and based on real experience.

SarchBazar may moderate, remove or restrict reviews that violate platform policies.

15. Vendor Packages, Digital Shop and Digital Mall Services

SarchBazar may offer vendor packages, digital shop services, digital mall services, business profile services, category integration, product listing tools, analytics dashboard, promotional support and other business enablement features.

SarchBazar does not guarantee customer traffic, revenue, profit, ranking, leads or business growth unless expressly agreed in writing.

16. Founder First and Business Enablement Services

SarchBazar may provide Founder First, self-entrepreneurship, business enablement, marketplace launch, vendor network, product feed, social commerce or growth-related services.

Income, profit, sales or business success is not guaranteed. Users are responsible for legal, tax, operational and business decisions.

17. Social Commerce and Partner Category Features

SarchBazar may enable social commerce, partner category integration, product sharing, cross-vendor visibility, referral tools, promotional offers or customer exchange features.

SarchBazar may restrict or disable misuse of social commerce or partner features.

18. Prohibited Products and Services

Users and vendors must not list, sell, promote or purchase products or services that are illegal, unsafe, counterfeit, restricted or prohibited by law or platform policy.

19. Prohibited User Conduct

Users must not use SarchBazar to violate any law, commit fraud, create fake accounts, abuse refunds, upload malware, hack the platform, manipulate ratings, harass users, misuse data, infringe intellectual property rights, impersonate others, or spread misleading information.

Violation may result in account suspension, order cancellation, payment hold, legal action or reporting to authorities.

20. Intellectual Property Rights

All rights in SarchBazar's platform, technology, design, branding, logos, trademarks, software, databases, dashboards, business processes, content arrangement and proprietary features belong to Talkfever Social Media Limited or its licensors.

21. Privacy and Data Use

Use of SarchBazar is governed by the Privacy Policy and Cookie Policy. Vendors must protect customer data and use it only for lawful order fulfilment and marketplace-related purposes.

22. Third-Party Services

SarchBazar may use third-party services such as payment gateways, courier partners, logistics aggregators, analytics tools, cloud hosting providers, advertising partners, verification providers and customer support tools.

SarchBazar is not responsible for failures, delays, errors, losses or disputes caused by independent third-party services, except where required by applicable law.

23. No Guarantee of Business Outcome

SarchBazar does not guarantee sales, profit, revenue, customer traffic, leads, orders, ranking, product visibility, vendor income, business success, marketplace demand, investor interest or any fixed earning outcome.

24. Platform Availability

SarchBazar aims to provide reliable services but does not guarantee uninterrupted, error-free, secure or continuous access. SarchBazar may modify, suspend, discontinue or restrict any feature, service or listing without prior notice where necessary.

25. Suspension and Termination

SarchBazar may suspend, restrict or terminate user accounts, vendor accounts, listings, orders, services or access if these Terms are violated, applicable law is violated, fraud is detected, payments are disputed, or platform security is threatened.

26. Limitation of Liability

To the maximum extent permitted by law, Talkfever Social Media Limited, SarchBazar, its directors, officers, employees, affiliates, partners, vendors and representatives shall not be liable for indirect, incidental, special, punitive, exemplary or consequential damages.

SarchBazar's total liability, if any, shall be limited to the amount paid by the user for the specific transaction or service giving rise to the claim, unless otherwise required by law.

27. Indemnity

You agree to indemnify and hold harmless Talkfever Social Media Limited, SarchBazar, its directors, officers, employees, affiliates, partners and representatives from any claims, losses, damages, liabilities, costs or expenses arising from your use of SarchBazar, your violations or your fraudulent activity.

28. Force Majeure

SarchBazar shall not be liable for delay, failure or non-performance caused by events beyond reasonable control, including natural disasters, pandemics, lockdowns, riots, war, strikes, government restrictions, cyberattacks, courier failure, power failure or internet outage.

29. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India. Subject to applicable law, courts and competent authorities having jurisdiction over Gwalior, Madhya Pradesh, India shall have jurisdiction over disputes arising from these Terms.

30. Changes to These Terms

SarchBazar may update these Terms of Use from time to time. Updated Terms will be posted on this page with a revised "Last Updated" date. Continued use of SarchBazar after updates means acceptance of the revised Terms.
